Our interest in this work is the sign of helplessness of a person, provided for in paragraph “c” of Part 2 of Art. 105 of the Criminal Code of the Russian Federation “Murder of a minor or another person known to the perpetrator to be in a helpless state.”

For domestic criminal legislation, this qualifying feature of murder is relatively new: its judicial interpretation was first given in paragraph 7 of the resolution of the Plenum of the Supreme Court of the Russian Federation of January 27, 1999 No. 1 “On judicial practice in cases of murder (Article 105 of the Criminal Code of the Russian Federation).” Its appearance was due to the prevalence of socially dangerous acts involving the abduction of elderly people and minors. Considering that abducted persons in most cases are in a helpless state, the legislator introduced this feature into the law.

When defining the concept of “helpless state,” the vast majority of authors reveal its content only by pointing to categories of people who are in a helpless state: minors, the elderly, and seriously ill people. The analyzed qualifying feature is in second place among all qualifying features that cause difficulty in application [1]. This is due, among other things, to the fact that it has not received an unambiguous interpretation in the criminal legislation of the Russian Federation. Helpless state is an assessment category, and when asked whether an official interpretation of the concept of “helpless state” is required, the majority of law enforcement officers (301 people) answered in the affirmative[2].

The resolution of the Plenum of the Supreme Court of the Russian Federation of January 27, 1999 No. 1 of January 27, 1999 “On judicial practice in murder cases (Article 105 of the Criminal Code of the Russian Federation)” states that persons in a helpless state include seriously ill people, the elderly, minors, people suffering from mental disorders, depriving them of the ability to correctly perceive what is happening.

Practice also raised the question: is sleep considered a helpless state? The Supreme Court of the Russian Federation clarified that sleep is a vital and physiologically conditioned state of a person, does not relate to a helpless state and cannot be qualified under clause “c” of Part 2 of Art. 105 of the Criminal Code of the Russian Federation[3].

The Plenum of the Armed Forces of the Russian Federation, in the above-mentioned resolution of January 27, 1999 No. 1, determined that the murder of a person who is known to the perpetrator to be in a helpless state should be qualified as “the intentional infliction of death on a victim who, due to his physical or mental condition, is unable to defend himself, to provide active resistance to the perpetrator when the latter, committing the murder, is aware of this circumstance.”

In the resolution of December 4, 2014 No. 16 “On judicial practice in cases of crimes against sexual integrity and sexual freedom of the individual,” a helpless state is understood as cases when a person, due to his physical or mental condition (dementia or other mental disorder, physical disabilities , other painful or unconscious state), age (young or elderly person) or other circumstances could not understand the nature and significance of the actions performed on him or resist the perpetrator. At the same time, a person committing rape or violent acts of a sexual nature must be aware that the victim is in a helpless state” (paragraph 5).

The state of intoxication can also be recognized as a helpless state; the courts must proceed from the fact that only such a degree of intoxication caused by the use of alcohol, drugs or other intoxicating (psychoactive) substances that deprived this person of the opportunity to understand the nature and meaning of the acts committed can be recognized as a helpless state. action with him or resist the guilty person. It does not matter whether the victim was brought into such a state by the perpetrator or was in a helpless state regardless of his actions (clause 6).

Thus, when assessing a helpless state, it is necessary to take into account not only objective data about the person’s helplessness, but also subjective circumstances about the perpetrator’s awareness of the fact that the victim is in such a state.

If the perpetrator was sure that when committing the murder the victim was not in a helpless state, which in fact was in such a state, then the sign of helplessness cannot be charged, and this act must be classified as “simple” murder.

On the other hand, Yu.E. Pudovochkin points out that if the subject of the crime is completely confident in the helpless state of his victim, but she was not actually in such a state, then the act should be qualified as an attempted murder of a person in a helpless state, since in this case there is a legal fiction – a completed crime is classified as unfinished [4].

Thus, the main sign in assessing the crime is a subjective sign - the assessment by the perpetrator of the state of helplessness of the victim.

Law enforcers evaluate sleep differently: sometimes attributing it to a helpless state, sometimes not.

According to the verdict of the Supreme Court of the Republic of Bashkortostan, the man was convicted under paragraph “c” of Part 2 of Art. 105 of the Criminal Code of the Russian Federation for committing the murder of M., who was in a helpless state. The court proceeded from the fact that at the time of the crime the victim was in a helpless state and was sleeping [5].

In our opinion, the uncertainty of the question of classifying sleep or not classifying it as a helpless state can, for the most part, be resolved by psychology.

Hypnosis is an artificial temporary shutdown of the conscious-volitional system of one person and its subordination to another. The state of a hypnotized person, according to one point of view, is characterized by a temporary cessation of mental activity. G.K. shares the same opinion. Kostrov, attributing hypnosis to bringing the target of a crime into a helpless state, because the person is deprived of any ability to control his will, emotions and actions.

At the same time, judicial practice does not recognize hypnosis as a qualifying sign of an unconscious state [8]. The discussion has been going on since the time of N.S. Tagantsev, who attributed the state of a hypnotized person to a temporary darkening of mental activity, a temporary state of unconsciousness. This position is consistent with the one according to which sleep (as the same unconscious state) does not belong to a helpless state. In addition to unconsciousness, a hypnotized person is also characterized by a helpless state, due to which the victim, for various reasons, cannot resist: he may be conscious, but he can no longer independently get out of the state of hypotaxia, performing active, purposeful volitional actions or inaction. Hypnosis can itself become a method of murder or causing harm to health of varying severity.

L.A. Andreeva believes that persons in a helpless state should be considered those who, due to some physiological and mental characteristics, cannot protect themselves, for example, due to age (infancy, old age).
